1. Welcome to Socialfy

Welcome to Socialfy.

These Terms of Use (“Terms”) govern your access to and use of the Socialfy website, website creation platform, hosting services, website templates, subscription plans, and other associated products and services (collectively, the “Services”).

Socialfy provides an online platform that enables individuals, businesses, entrepreneurs and organisations to create, customise, publish and manage their own websites without requiring advanced technical knowledge.

By accessing Socialfy, registering an account, creating a website, purchasing a subscription or otherwise using our Services, you agree to comply with these Terms.

If you do not agree with these Terms, you must not use our Services.

Throughout these Terms:

  • “Socialfy”, “We”, “Us” and “Our” refer to the operator of https://socialfy.co.uk.
  • “User”, “Customer”, “You” and “Your” refer to any individual or organisation accessing or using our Services.
  • “Platform” refers to the Socialfy website creation and management system.
  • “User Website” refers to any website created, hosted or managed through Socialfy.
  • “Content” means any text, images, videos, audio, graphics, files, links, products, comments or other material uploaded, published or distributed using our Services.
  • “Subscription” refers to any free or paid plan made available through Socialfy.

These Terms apply to all visitors, registered users, website owners and paying subscribers.

2. Eligibility and Account Registration

To create an account or use Socialfy’s website creation services, you must:

  1. Be at least 18 years old or have the appropriate legal capacity to enter into a binding agreement.
  2. Provide accurate, complete and up-to-date registration information.
  3. Maintain the confidentiality of your username, password and account credentials.
  4. Ensure that your use of the Platform complies with applicable laws and regulations.
  5. Accept responsibility for activities carried out through your account, except where caused by our own breach of duty or security obligations.

You must not impersonate another person, register accounts using misleading information, or access accounts without authorisation.

Socialfy reserves the right to suspend or restrict accounts where we reasonably believe that registration information is fraudulent, misleading or used in violation of these Terms.

You must notify Socialfy promptly if you suspect unauthorised access to your account.

3. Website Creation and Hosting Services

Socialfy allows users to create and manage websites using available website templates, themes, plugins and customisation tools.

Depending on your selected subscription plan, features may include:

  • Website creation and hosting.
  • Access to pre-designed website templates.
  • Website customisation and content management.
  • Business, personal, portfolio or e-commerce website functionality.
  • Subdomain or custom domain functionality.
  • Website administration and management tools.
  • Additional features included in your chosen plan.

The availability of individual features depends on your subscription, technical requirements and any applicable third-party services.

Socialfy may update, improve, replace or discontinue particular features where reasonably necessary for security, maintenance, compatibility, legal compliance or service development.

Where a change materially disadvantages a paying customer, we will provide appropriate notice and any rights or remedies required by applicable law.

Socialfy does not guarantee that every third-party theme, plugin or integration will remain compatible with the Platform.

4. Free and Paid Subscription Plans

Socialfy may offer both free and paid subscription plans.

Each subscription plan may include different features, storage allowances, website templates, resource limits and additional services.

The features and price of each plan will be displayed during registration or checkout.

4.1 Free Plans

Free plans may be subject to limitations, including restricted access to certain templates, storage capacity, custom domains or other premium features.

Socialfy may modify free plan features or introduce reasonable usage restrictions by providing notice where appropriate.

4.2 Paid Plans

Paid subscriptions are charged at the price and billing frequency displayed at checkout.

By purchasing a paid subscription, you authorise Socialfy and its authorised payment processors to collect the applicable fees.

4.3 Automatic Renewal

Where a subscription is advertised and sold as automatically renewing, it will renew at the stated billing interval unless cancelled.

The renewal terms, payment frequency and applicable charges will be disclosed before purchase.

You may cancel your subscription through the available account management facilities or by contacting Socialfy.

Unless applicable law provides otherwise, cancellation normally prevents future renewal charges but does not automatically result in a refund for a billing period already paid for.

We will comply with applicable laws governing recurring payments, cancellation, renewal notices and refunds.

4.4 Changes to Subscription Prices

Socialfy may change subscription prices.

Any increase affecting an existing subscription will be communicated in advance, together with the date on which the revised price takes effect and any applicable cancellation rights.

We will not apply a higher price to an existing paid billing period retrospectively.

5. Payments and Billing

Payments for Socialfy subscriptions and services may be processed through authorised third-party payment providers, including PayPal or other supported payment gateways.

By submitting payment information, you confirm that:

  1. You are authorised to use the selected payment method.
  2. Your billing information is accurate.
  3. You agree to pay the charges clearly disclosed during checkout.
  4. You authorise applicable recurring payments where you expressly select a recurring subscription.

Prices will be displayed in the applicable currency, normally Pounds Sterling (GBP), with applicable taxes and charges identified at checkout.

Socialfy does not intentionally store complete payment card details where those details are collected directly by a third-party payment processor.

Payment processors may apply their own terms, privacy policies, fraud prevention measures and security requirements.

If a payment fails, Socialfy may notify you, request updated payment information, temporarily restrict paid features or suspend the affected subscription after reasonable notice.

Any payment dispute should be reported to Socialfy so that we have an opportunity to investigate and resolve the issue.

We will not penalise customers merely for exercising lawful chargeback, complaint or statutory consumer rights.

Fraudulent payment activity may result in account suspension or termination.

6. Cancellation and Refund Policy

We aim to ensure that subscription charges and cancellation arrangements are clear and transparent.

6.1 Subscription Cancellation

You may request cancellation of a paid subscription at any time.

Where possible, subscriptions can be cancelled from your account dashboard. Alternatively, you may contact Socialfy through the contact facilities provided on our website.

Cancellation of automatic renewal will prevent future renewal charges, subject to any valid contractual commitments that were clearly disclosed at purchase.

6.2 Consumer Cancellation Rights

If you purchase Socialfy services as a consumer, rather than wholly or mainly for business purposes, you may have a statutory 14-day cancellation right under applicable UK consumer law.

The treatment of services and digital content can differ.

Where you expressly request that a service begins during the cancellation period, we may be entitled to charge a proportionate amount for services supplied before cancellation, where permitted by law and subject to the required information and consent being obtained.

Where digital content is supplied immediately, statutory cancellation rights may be affected only where the legal conditions have been satisfied, including any necessary express consent and acknowledgement.

Nothing in these Terms removes or restricts your statutory rights.

6.3 Refund Requests

Refund requests will be assessed in accordance with applicable law and the circumstances of the purchase.

Refunds may be available where:

  • A statutory cancellation right applies.
  • Services have not been supplied as required by the contract.
  • There has been a qualifying billing error or duplicate payment.
  • A refund is required under applicable consumer protection legislation.
  • Socialfy agrees to provide a discretionary refund.

Any discretionary refund remains separate from your statutory rights.

6.4 Account and Website Data Following Cancellation

Cancelling a subscription may affect access to premium features and hosting services.

If a paid subscription expires, Socialfy may restrict the associated website or revert available features in accordance with the terms of the selected plan.

Customers are responsible for retaining appropriate backups of their content.

Where technically available, customers may request an export of their website content before account closure or deletion.

Any applicable data retention, portability or access rights will be handled in accordance with relevant law and our Privacy Policy.

7. Website Ownership and User Content

You retain ownership of the original content that you create or upload to your Socialfy website, subject to any rights held by third parties.

This may include your business name, original text, photographs, logos, videos and other materials.

You are responsible for ensuring that you have the necessary rights, permissions and licences to use and publish such content.

By uploading content to Socialfy, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, transmit and technically adapt that content solely as reasonably necessary to operate, maintain, secure and provide the Services.

This licence does not transfer ownership of your original content to Socialfy.

Unless you separately authorise it, Socialfy will not claim ownership of your business branding, original written content or uploaded media simply because it is hosted on our Platform.

Templates, themes, plugins, website-building software and other resources supplied by Socialfy or third parties remain subject to their applicable ownership and licensing arrangements.

Creating a website using a Socialfy template does not automatically transfer ownership of that template or its underlying source code to you.

8. Intellectual Property and Licensing

Unless otherwise stated, the intellectual property rights in the Socialfy brand, logos, website design, software, proprietary templates, documentation and original Platform materials belong to Socialfy or its respective licensors.

All applicable intellectual property rights are reserved.

You are granted a limited, non-exclusive, non-transferable right to use the Platform and included resources for their intended purposes while you comply with these Terms.

You must not, except where permitted by law or the relevant licence:

  1. Copy or redistribute proprietary Socialfy software or templates.
  2. Resell or sublicense Platform components without authorisation.
  3. Remove copyright notices, licence information or proprietary markings.
  4. Attempt to gain unauthorised access to restricted software or systems.
  5. Reverse engineer protected components where prohibited by applicable law.
  6. Represent Socialfy’s proprietary materials as your own.

Certain open-source components, including WordPress and compatible plugins or themes, may be governed by separate licences.

Nothing in these Terms restricts rights granted directly to you under applicable open-source licences.

9. Acceptable Use Policy

Socialfy is intended to provide a reliable, lawful and secure website creation environment.

You agree not to use the Platform to create, host, distribute or promote unlawful or prohibited content or activities.

Prohibited uses include:

  1. Illegal activities: Websites facilitating fraud, identity theft, financial crime or other unlawful conduct.
  2. Malware and malicious software: Distributing viruses, ransomware, spyware or harmful code.
  3. Phishing and impersonation: Creating fraudulent websites designed to obtain passwords, personal information or financial details.
  4. Copyright infringement: Uploading or distributing material without the required rights or permissions.
  5. Harassment and threats: Publishing unlawful threats, harassment or abusive communications.
  6. Child sexual abuse material: Creating, uploading, sharing or linking to any such material.
  7. Non-consensual intimate imagery: Publishing or distributing intimate images without lawful consent.
  8. Unlawful discrimination or hate content: Publishing content prohibited by applicable law.
  9. Spam: Sending unsolicited communications or operating websites primarily intended for unlawful or abusive spam activities.
  10. Unauthorised system access: Hacking, exploiting vulnerabilities or interfering with other users’ websites.
  11. Resource abuse: Using excessive server resources, cryptocurrency mining or automated activity that materially disrupts the Platform.
  12. Misleading commercial activity: Operating fraudulent shops, deceptive payment pages or unlawful schemes.

Users must comply with all applicable laws relevant to the content, products and services provided through their websites.

Socialfy may impose additional reasonable restrictions on particular categories of content or website functionality where required for legal compliance, infrastructure security or third-party service compatibility.

10. E-Commerce and Customer Transactions

Where your Socialfy plan supports e-commerce or online ordering functionality, you are responsible for operating your business lawfully.

This includes, where applicable:

  • Providing accurate product or service descriptions.
  • Displaying prices and applicable taxes correctly.
  • Establishing lawful payment, delivery and refund policies.
  • Complying with consumer protection legislation.
  • Handling customer complaints and returns.
  • Providing appropriate business contact information.
  • Meeting applicable data protection requirements.
  • Complying with product safety and industry-specific regulations.

Unless Socialfy expressly agrees otherwise, transactions between a website owner and their customers are the responsibility of the website owner.

Socialfy is not automatically the seller or supplier of goods or services offered through independently operated User Websites.

Socialfy does not guarantee sales, revenue, search engine rankings, customer conversions or business performance.

11. Content Moderation and User Safety

Socialfy is committed to maintaining a safe, secure and respectful environment.

We may review, investigate or remove content that appears to breach these Terms or applicable law.

11.1 Content Monitoring

Socialfy may employ security monitoring, automated detection tools and manual reviews where appropriate.

We do not guarantee that all user-generated content will be reviewed before publication.

11.2 Reporting Content

Users and visitors may report suspected unlawful content, security concerns, copyright infringement or abuse through the contact facilities available at:

https://socialfy.co.uk

Reports should include sufficient information to identify the website or content concerned and explain the nature of the complaint.

11.3 Enforcement

Where reasonably necessary and proportionate, Socialfy may:

  • Request removal or correction of content.
  • Temporarily restrict access to a website.
  • Disable specific features.
  • Suspend or terminate accounts.
  • Remove unlawful or prohibited material.
  • Preserve relevant information where legally permitted or required.
  • Report suspected unlawful activity to appropriate authorities where required or justified.

We will seek to assess reports promptly, taking account of their urgency, seriousness and legal requirements.

We do not guarantee a fixed resolution time for every report.

11.4 Appeals and Disputes

Where appropriate, users may contact Socialfy to request a review of account restrictions or content moderation decisions.

Nothing in this section limits any statutory rights or complaint procedures available under applicable law.

12. User Websites and Third-Party Content

Socialfy provides the infrastructure and tools through which users can publish websites.

The views, opinions, products, services and information appearing on User Websites are generally those of the relevant website owners.

They do not necessarily represent the views or endorsements of Socialfy.

Website owners are responsible for ensuring their content is accurate and lawful.

To the extent permitted by law, Socialfy is not responsible for independent statements or transactions made by third-party website owners merely because their websites use our Platform.

We may remove or restrict content when required by law, these Terms or applicable regulatory obligations.

13. Website Domains and Subdomains

Depending on your subscription plan, Socialfy may provide a hosted subdomain or functionality allowing you to connect a custom domain name.

Users are responsible for ensuring that their chosen domain names do not infringe third-party rights.

A Socialfy-provided subdomain remains part of the Platform’s domain infrastructure and is made available for use subject to these Terms.

A custom domain registered through an independent domain registrar remains subject to the applicable registrar’s conditions.

Unless expressly included in your subscription, domain registration, renewal, transfer and related charges may be payable separately.

Socialfy cannot guarantee the availability of a requested domain name.

Upon account termination, the right to use a Socialfy-provided subdomain may cease.

14. Service Availability and Maintenance

Socialfy aims to provide reliable hosting and website services.

However, occasional interruptions may occur because of:

  • Scheduled maintenance.
  • Software updates.
  • Server or infrastructure failures.
  • Internet connectivity issues.
  • Cybersecurity incidents.
  • Third-party service failures.
  • Events beyond our reasonable control.

We will take reasonable steps to maintain and restore the Services.

Where practical, advance notice will be provided for maintenance likely to cause significant disruption.

Unless expressly stated in a separate service level agreement, Socialfy does not guarantee uninterrupted or error-free service.

Nothing in this section excludes liability for failing to provide services with the standard of care and skill required by applicable law.

15. Data Protection and Privacy

Socialfy respects the privacy of its users and is committed to handling personal information lawfully.

We process personal data in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.

Personal information may be collected and processed for purposes including:

  • Account registration and authentication.
  • Providing website hosting services.
  • Subscription and payment administration.
  • Customer support.
  • Platform security and fraud prevention.
  • Service communications.
  • Compliance with legal obligations.

Further details about personal data processing, lawful bases, retention periods, data sharing and individual rights will be set out in our Privacy Policy.

Website owners are independently responsible for understanding and fulfilling their data protection obligations concerning information collected from visitors and customers through their own websites.

Depending on the circumstances, Socialfy may process certain website visitor data on behalf of website owners. Where legally required, suitable data processing arrangements must be established.

16. Cookies

Socialfy uses cookies and similar technologies to operate, secure and improve the Platform.

Cookies may be used to:

  1. Maintain account login sessions.
  2. Remember website preferences.
  3. Support checkout and payment functionality.
  4. Protect against fraud and unauthorised access.
  5. Analyse website performance where permitted.
  6. Support optional marketing or advertising features where permitted.

Strictly necessary cookies may be used without consent where an applicable legal exemption applies.

For non-essential cookies, including applicable analytics and advertising cookies, we will seek consent where required by law.

Users should be provided with appropriate controls to manage non-essential cookie preferences.

More information about our use of cookies will be provided through our Privacy Policy or Cookie Policy.

17. Security and Backups

Socialfy takes reasonable technical and organisational measures to protect the Platform.

However, no internet-based system can be guaranteed to be completely secure.

Users are responsible for:

  • Choosing strong passwords.
  • Keeping account credentials confidential.
  • Managing website administrator access.
  • Ensuring uploaded files are safe and lawful.
  • Maintaining suitable copies of important website content.
  • Reporting suspected security vulnerabilities or account compromises promptly.

Socialfy may maintain operational backups for security, disaster recovery or infrastructure maintenance.

Unless expressly included in a subscription or separate agreement, these backups do not constitute a guaranteed individual website restoration service.

Users should maintain their own appropriate backups, particularly for business-critical websites.

18. Suspension and Termination

Socialfy may suspend, restrict or terminate access to an account or User Website where there are reasonable grounds to believe that:

  1. These Terms have been materially breached.
  2. The Platform is being used for unlawful activity.
  3. Account activity creates a significant security risk.
  4. Payment obligations remain unpaid after appropriate notice.
  5. Website activity threatens the stability or security of the service.
  6. We are required to act by law or a competent authority.

Where appropriate, we will provide notice and an opportunity to remedy a breach before termination.

However, immediate action may be necessary where there is serious unlawful activity, fraud, abuse or an urgent security threat.

Termination may result in loss of access to a website or account.

Any content deletion will be carried out in accordance with our applicable retention arrangements, legal obligations and the user’s statutory rights.

Termination does not remove rights or obligations that accrued before the termination date.

19. Links to Third-Party Websites

Socialfy and User Websites may contain links to external websites, applications or services.

These external resources are not necessarily controlled or operated by Socialfy.

We do not automatically endorse third-party content, products or services merely because they are linked from the Platform.

Users should review the applicable terms, privacy policies and security practices of third-party providers.

Socialfy is not responsible for the independent actions of third-party providers except where responsibility arises under applicable law or our contractual obligations.

20. Limitation of Liability

Nothing in these Terms shall exclude or limit liability where doing so would be unlawful.

In particular, nothing shall exclude or limit liability for:

  1. Death or personal injury caused by negligence.
  2. Fraud or fraudulent misrepresentation.
  3. Any liability that cannot legally be excluded or restricted.
  4. Any statutory consumer rights or remedies that cannot lawfully be restricted.

Socialfy will provide its Services with reasonable care and skill, as required by applicable law.

For customers using the Services wholly for business purposes, and to the extent permitted by law, Socialfy will not be responsible for indirect or consequential losses, lost profits, lost business opportunities or anticipated savings arising from events outside our contractual responsibility.

Any limitations of liability are subject to applicable law and must be interpreted consistently with the remaining provisions of these Terms.

For consumers, nothing in these Terms limits remedies available for services or digital content that fail to meet applicable statutory requirements.

21. Indemnification

Where you use Socialfy for business purposes, you agree to indemnify Socialfy against reasonable third-party claims, losses and costs arising directly from your unlawful content, wilful misconduct or material breach of these Terms, to the extent that those losses were caused by your actions.

This obligation does not apply to losses caused by Socialfy’s own negligence, misconduct or breach of contract.

Nothing in this section restricts the statutory rights of consumers or imposes liability that would be unlawful or unfair under applicable consumer legislation.

22. Changes to These Terms

Socialfy may update these Terms from time to time to reflect:

  • Changes to our services.
  • New platform functionality.
  • Changes in applicable legislation.
  • Updated security requirements.
  • Changes to subscription arrangements.
  • Other legitimate operational requirements.

The latest version will be published on https://socialfy.co.uk with an updated revision date.

Where changes materially affect existing users, we will provide reasonable advance notice where required.

Changes will not retrospectively remove rights or remedies that users have already acquired.

If a material change affects a paid subscription, customers will retain any cancellation or other rights required by law.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, subject to any mandatory legal protections available to consumers in their place of residence.

Disputes involving business customers will be subject to the courts of England and Wales, unless otherwise required by law or agreed between the parties.

Consumers may have the right to bring proceedings in other courts where applicable consumer legislation permits.

Nothing in this section limits mandatory consumer protections or statutory legal rights.
